1. Acceptance of Terms

These Terms of Use ("Terms") form a binding agreement between you and Every Bit Texas ("the Site," "we," "us," or "our"). By submitting content through our submission forms and checking the box affirming your agreement to these Terms, you accept and agree to be bound by them. Your affirmative acceptance, together with the date and time it is recorded, constitutes your electronic signature to this agreement. If you do not agree to these Terms, do not submit content to the Site.


2. User-Submitted Content

2.1 License Grant

By submitting any content to Every Bit Texas — including photographs, images, video, audio, text, stories, documents, or other materials ("Submitted Content") — you grant Every Bit Texas a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, fully paid-up, transferable, and sublicensable license to use, reproduce, host, store, publish, display, perform, distribute, transmit, adapt, modify, edit, crop, translate, create derivative works from, sublicense, and otherwise exploit your Submitted Content, in whole or in part, in any media or format now known or hereafter developed, for any purpose, including commercial, editorial, promotional, advertising, and syndication purposes, without any further notice, attribution, or compensation to you.

2.2 No Compensation

You acknowledge and agree that no compensation, payment, or consideration of any kind will be due to you for your Submitted Content or for any exercise of the rights granted under these Terms, now or in the future.

2.3 You Retain Copyright

This license does not transfer copyright ownership of your Submitted Content to Every Bit Texas. You retain all ownership rights you hold in your Submitted Content, subject to the license granted above.

2.4 Waiver of Moral Rights

To the fullest extent permitted by applicable law, you waive, and agree not to assert against Every Bit Texas or its licensees, any moral rights or rights of attribution or integrity you may have in your Submitted Content, including any right to object to its modification, adaptation, editing, or use in any context.

2.5 Representations and Warranties

By submitting content, you represent and warrant that:

  • You are the sole creator and owner of the Submitted Content, or you have obtained all necessary rights, licenses, consents, and permissions to submit it and to grant the license set out above;
  • The Submitted Content is original and does not copy, infringe, or violate the copyright, trademark, privacy, publicity, or any other rights of any person or entity;
  • You have obtained the consent of every identifiable person appearing in the Submitted Content (or, where a person is deceased or a minor, from the appropriate authorized party) to its submission and use as described in these Terms;
  • The Submitted Content is not the subject of any pending or threatened legal claim or dispute;
  • You are at least 18 years of age;
  • The Submitted Content is not defamatory, obscene, unlawful, or otherwise objectionable.

2.6 Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Every Bit Texas and its owners, officers, employees, agents, and licensees from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your Submitted Content, your use of the Site, or any breach of these Terms or of any representation or warranty you have made.

2.7 Removal Does Not Terminate the License

You may request removal of your Submitted Content from public display on the Site, and we will make reasonable efforts to honor such requests. However, because the license granted in Section 2.1 is irrevocable, removal from the Site does not terminate or limit any license already granted, and does not require us to recall, retract, or destroy copies, derivative works, or syndicated or distributed versions of the Submitted Content created or shared before removal.

2.8 No Obligation to Publish

Every Bit Texas reserves the right, in its sole discretion, to review, edit, reject, remove, or decline to publish any Submitted Content at any time and for any reason.


3. Intellectual Property

All original content on Every Bit Texas — including editorial text, design, logos, trademarks, and compilations — is the property of Every Bit Texas and protected by applicable copyright and intellectual property laws. Nothing in these Terms grants you any right to use Every Bit Texas branding, marks, or proprietary content without our prior written permission.


4. Prohibited Conduct

You agree not to submit content that:

  • You do not have the right to submit;
  • Infringes any third-party copyright, trademark, or other intellectual property right;
  • Contains private or personal information about any individual without their consent;
  • Is false, misleading, defamatory, or fraudulent.

5. Copyright Complaints (DMCA)

Every Bit Texas respects the intellectual property rights of others. If you believe content on the Site infringes your copyright, please send a written notice to our designated agent at info@everybittexas.com that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and its location on the Site; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will respond to valid notices in accordance with the Digital Millennium Copyright Act, including by removing or disabling access to the material. A person who submitted material that is removed may file a counter-notification. We reserve the right to terminate, in appropriate circumstances, the privileges of any contributor who repeatedly submits infringing content.


6. Privacy and Data

When you submit content, we collect information you provide (such as your name and email address) and certain technical information (such as your IP address) to operate the Site, review submissions, and maintain a record of your agreement to these Terms. Your use of the Site is also governed by our Privacy Policy , which is incorporated into these Terms by reference.


7. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Every Bit Texas does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.


8. Limitation of Liability

To the fullest extent permitted by applicable law, Every Bit Texas shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits or data, arising from or related to your use of the Site or submission of content, regardless of the theory of liability.


9. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date above and, where the changes are material, provide reasonable notice (for example, by posting a notice on the Site or, where we have your email address, by email). Revised Terms apply only on a going-forward basis, from their stated effective date, and only to content submitted on or after that date. Changes to these Terms do not alter, revoke, or apply retroactively to the license granted for content you submitted before the effective date of the change; that content remains governed by the Terms in effect when it was submitted. If you do not agree to revised Terms, your remedy is to stop submitting content; continued submission after the effective date constitutes acceptance of the revised Terms.


10. General Provisions

Governing Law and Venue. These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Galveston County, Texas, and you consent to personal jurisdiction there.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Every Bit Texas regarding your Submitted Content and use of the Site, and supersede any prior agreements on that subject.

Assignment. You may not assign these Terms. Every Bit Texas may freely assign or transfer these Terms and the licenses granted under them, in whole or in part, including in connection with a sale, merger, or other transfer of its business or assets.

No Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Survival. Sections 2 (User-Submitted Content), 3 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), and 10 (General Provisions) survive any termination of these Terms or of your use of the Site.
